1. INTRODUCTION
1.1 This Privacy Policy (the “Policy”) has been prepared to provide better information to you regarding how your personal data is used, including informing you of your rights as well as our guidelines and procedures for processing your personal data. Where the words “you” or “your” are used in this policy, this refers to you as the user.
1.2 When the words “we,” “us,” or “our” are used in this policy, this refers to FlexMed AS, org. no. 930 843 865.
1.3 By using our solutions and services, you confirm that you have read and understood this policy. Please read the policy carefully to gain a clear understanding of how we process your personal data.
 
2. PURPOSE
2.1 The term “personal data” refers to any information that can be linked to an identified or identifiable person. A person is considered identifiable if they can be identified directly or indirectly, for example through name, identification number, location data, or online identifiers. Personal data also includes information related to physical, physiological, genetic, mental, economic, cultural, or social conditions. In short, it covers all information that can be used to recognize or distinguish a person, either alone or in combination with other information.
2.2 We process personal data for the following purposes:
  • a) Accounting: We must register and store certain information for accounting purposes when your personal data is part of the basis for accounting transactions.
  • b) Camera Management: We process your personal data during the setup and operation of care cameras, door sensors, and alarm buttons in your home, as well as providing access to live video with audio (24/7) and receiving alerts when the door is opened/closed or the alarm button is pressed.
  • c) Complaints, Requests, and Disputes: We process complaints and handle inquiries from you.
  • d) Identity Verification: We must confirm your identity and the identity of any relatives you grant access to the app.
  • e) Customer Follow-up: We may process your personal data in connection with marketing, sales, and follow-up of customer relationships.
  • f) Internal Processing: Conducting internal investigations and risk assessments.
  • g) Securing Systems and Premises: We must secure our systems, offices, and working environment. This may involve processing access information and log data.
  • h) Threat Detection: We may process your personal data to detect and prevent fraud, spam, abuse, technical problems, and security incidents.
2.3 We may also process personal data for purposes other than those mentioned here, provided that these are compatible with the original purpose for which the information was collected.
 
3. PERSONAL DATA
3.1 Personal data is information about a physical person who can be identified directly or indirectly.
3.2 This policy does not cover anonymized data where identity cannot be established. We reserve the right to use such data freely.
3.3 To fulfill the purposes in section 2, we may process, among other things:
  • a) App Usage Data: Video recordings, door sensor activity, and use of the alarm button, depending on the subscription.
  • b) Delivery Information: Address for the purchase of equipment.
  • c) Payment Information: Credit card details for subscriptions or purchases.
  • d) User Information: First name, last name, email, phone number, and national ID number (or secure BankID login).
3.4 Personal data is mainly collected directly from you but may also be received from third parties, such as the user or relatives.
 
4. LEGAL BASIS
4.1 Processing is necessary to fulfill an agreement with you and/or our legal obligations, cf. GDPR Article 6 No. 1 letters b and c.
4.2 For processing as mentioned in section 2 (e–h), the basis is our legitimate interest, cf. GDPR Article 6 No. 1 letter f.
4.3 In certain cases, we will ask for your consent, cf. GDPR Article 6 No. 1 letter a.
 
5. DATA CONTROLLER
5.1 Unless otherwise stated, we are the data controller for your personal data.
 
6. YOUR RIGHTS
6.1 You have the right to:
  • a) Access to your own data
  • b) Data portability
  • c) Deletion
  • d) Information
  • e) Objection to processing
  • f) Rectification of data
  • g) Restriction of processing
 
7. STORAGE
7.1 We store information as long as it is necessary for the purpose.
7.2 Examples of storage periods:
  • a) Account Information: As long as the account exists.
  • b) Payment/Delivery: According to legal requirements (e.g., the Accounting Act).
  • c) Uploaded Content: Until it is deleted by the user.
  • d) Video Recordings: 3 days (Standard) / 7 days (Premium).
 
8. THIRD PARTIES
8.1 Information may be shared with authorities, partners, and service providers when necessary.
8.2 These must comply with current privacy legislation and our instructions.
 
9. SECURITY
9.1 We protect your information through technical and organizational measures to prevent loss, misuse, or unauthorized access.
 
10. INTERNATIONAL TRANSFER
10.1 Information is mainly processed within the EEA. For transfers outside the EEA, adequate protection is ensured through approved transfer mechanisms.
 
11. CHANGES
11.1 This policy may be updated as needed. In case of significant changes, we will notify you.
